If you disagree, you are prohibited from entering this website and playing Gartic. We reserve the right to change the Terms and Conditions and the Privacy Policy anytime. Your continued use of the website after changes to this policy will be deemed your acceptance of such changes. The materials on this site are protected by applicable copyright and trademark. A minor (anyone under 13 years of age) must seek the consent of their legal guardian to use the website and the Gartic game. Gartic encourages parents to instruct their children never to share personal information online. Parents who are concerned about transferring their children's personal information may contact us. 2. License to use Permission is granted to temporarily transfer a copy of the materials on the Gartic website for personal and non-commercial transient viewing. This is the granting of a license, not a transfer of title, and under this license, you may not: - Attempting to decompile or reverse engineer any software contained on the Gartic website; - Remove any copyrights or other proprietary notices of the materials; or - Transfer the materials to another person or "mirror" the materials on any other server. This license must end automatically if you violate any of these restrictions. At the end of viewing these materials or after termination of this license, you must destroy all materials in your possession, whether in electronic or printed form. We reserve the right to take legal action against you if you violate the trademark license. 3. Intellectual property rights Gartic is the owner of all of the Services' contents, including, but not limited to, logos, icons, trademarks, graphics, text, images, moving images, designs, sound, illustration, software, domains, and so on (the "Intellectual Property Rights"). We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Gartic game on the website and download and install a copy of the app on a mobile device that you own or control upon acceptance of these Terms. Any use of Intellectual Property Rights that are not expressly permitted in these Terms, by applicable law, or by us is strictly forbidden. When you create drawings (hereinafter referred to as "User Generated Content"), you grant us a perpetual, royalty-free, worldwide, exclusive license to use, process, access, modify, display, market, and copy User Generated Content, if applicable. To the extent permitted by applicable law, you waive your moral right and User Generated Content. You have permission to distribute User Generated Content on any social network or device. You may request their consent if other users engage in the created material. If you do not act in this manner and the user claims their rights, you will be held liable for any disputes arising from these concerns. You are not permitted to commercialize User Generated Content that contains the Gartic logo, which is owned by us and licensed to us. Besides, it is protected by copyright and trademark laws, such as various other intellectual property rights and unfair business practices laws in the United States, international copyright laws, and international conventions. 4. Commercial use You are allowed to broadcast the game on any live-streaming platform, and you may also be allowed to create and post videos on any video platform or website. We thank you for including Gartic in your video's content and encourage you to do so. - You can broadcast Gartic's gameplays on any live-streaming platform and create and post videos on any video platform or website as long as you commit to the following: - Your videos shall be available to consumers free of charge at the time of consumption, and your revenue shall come from other sources, such as sponsors or advertisement banners in your videos; - Maintain Gartic's name in the live stream or video's title, and include the game's website link in the description; - Not include illegal, violent, offensive, pornographic, or otherwise improper content in your stream/videos; - Not mislead the viewers into believing that Gartic agrees with the personal opinion of the streamer/video creator or the live stream/video's subject; - Use only your unique content to the live stream/videos or content you have rights to use, such as pictures, sound, music, etc.; - Not sell physical copies of the videos, such as DVDs or similar; - Only use our Assets to distribute your videos through channels that are provided pay-per-view or require a paid subscription if such videos are also made available to consumers free of charge. You may utilize Gartic as content in your videos on the occasions that your live stream or video is sponsored by a brand, business, or agency, but only if you agree to: - Not infringe any of Gartic's intellectual property rights; - Not allow video and live stream content, including but not limited to images, descriptions, features, communication, script, description, or hashtag usage, that mislead viewers, which they may think Gartic agrees with and endorse with any sponsor-related content; - Not mislead the viewers into believing that Gartic sponsors the live stream, video, streamer, or channel. The license will be automatically revoked upon violating any of the conditions outlined in these terms. 5. Feedback If you send us ideas or feedback, you agree that we may freely use or reference those ideas and feedback and do not owe you any payment or have any other obligation of any kind for such ideas or feedback. 6. Limitations In no event will Gartic or its suppliers be liable for any direct, indirect, incidental, special, or consequential damages resulting from the inability to use the game. We do not accept any responsibility for external links sent by the user or user-generated content such as messages, profile images, or words. The content of these publications does not mean that we endorse the material. We are not liable for any loss, damage, or inconvenience you may experience due to sending these materials. We are also not responsible for any damage you may suffer due to the game being temporarily or permanently unavailable for maintenance or due to technical problems. 7. Applicable law These terms and conditions are ruled and construed under the laws of Brazil, and you irrevocably submit yourself to the exclusive jurisdiction of the courts in this State or place. 8. Advertisements If you click on an ad, you'll be dealing with outside companies responsible for that advertisement. We do not control the actions of these companies, nor do we control the content of their sites. Report any ad you find offensive or inappropriate at team@gartic.com. If we consider that this ad violates our advertising standards, we will take suitable action. We are not responsible for any loss, damage, or inconvenience you suffer from viewing or clicking on advertisements under any circumstances. You must complain directly against the external company responsible for the ad. 9. User Conduct You must treat all users with respect and comply with the updated website's terms, conditions, and policies. Respect the other users of the game. Inappropriate language and inappropriate behavior are prohibited. That way, the author can be banned from the site. We are not responsible for user content, posts, chat, and other types of communication. Users are responsible for their actions and all the consequences that may arise from there. You agree not to take any action such as: a) Distribute, make available, write in the chat, the field of responses and/or design any content that we deem to be: defamatory, abusive, harassing, insulting, threatening, intolerant, vulgar, sexually explicit, intolerant, defending illegal activities, doing discrimination, be it social, religious, racial, sexual, political, sport, age, origin, nationality, color, disease, religion, religion or belie, marital status, family situation or any characteristic that excludes the person socially or causes embarrassment thereof, being directed to any player, family, friends or any other person outside the site. Drawings containing any quoted content may be canceled at the match, and the player may be banned from the site. b) Post, distribute, make available, or transmit any information, text, message, or other material that violates any right of a third party or any national or international law, rule, or regulation, including but not limited to: - Copyrights, patents, trademarks or other proprietary rights; - Right to privacy (specifically, you should not distribute personal information of another person without any express permission) or publicity; c) Advertise or sell products, services, or other (for-profit or non-profit); d) Post, distribute, make available, or transmit any software or other computer file that contains a virus or other harmful component; e) Represent any person or entity or misrepresent its identity with any person or entity; f) Engaging in antisocial or destructive acts; g) Create or use any server emulator; h) Exclude any legal notices, exemptions, or proprietary notices, such as copyright or trademark symbols, or modify any logo that you do not have or have express permission to modify; i) Use nicknames that we consider offensive, inappropriate or that you are not authorized to use, in which case you may be banned from the site; j) Use automatic programs or scripts, including but not limited to web spiders, crawlers, robots, ants, indexers, bots, viruses or worms, or other programs that may make multiple server requests per second or that unnecessary burden or hinder the operation and performance of the Services; k) Disrupt or obstruct the game’s capacity or performance or data contained in it or attempt to gain unauthorized access to the game or its related systems or networks; l) Use Gartic as a hold for illegal purposes; m) To attempt to do damage to us in any way; n) To solicit others to perform or participate in any unlawful act; p) To embed the Gartic into any third-party websites and platforms without first receiving permission from us and signing a partnership agreement. q) To spam, phish, pharm, pretext, spider, crawl, or scrape; r) To create any obscene or immoral content; t) To interfere with or circumvent the security features of the game, third-party products and services, or the Internet. 9.1 A player may be kicked out of the room by voting in a match. We will not be liable for any inconvenience caused by player actions; 9.2 A player may only report a drawing if it violates any previous rules. 9.3 Players cannot write the answer, or part of it, in the chat. Also, they should not send synonyms, accent marks, punctuation (hyphen), popular phrases, color or shape suggestions for drawings, corrections of drawings, puns, advertisements or music, or any other type of help to find the answer. If the player sends letters, texts, or words in the answer field to indicate the correct answer to other players, it will be considered an infraction. This license must automatically terminate if you violate any of these restrictions; we have the right to investigate and may involve and cooperate with authorities to prosecute offenses committed through the Services. 10. Considerations If you believe that another user's behavior violates these Terms and Conditions, please let us know by emailing team@gartic.com. We will take reasonable steps to properly investigate and handle any breach by the Data Protection Regulation. We will not be liable for any loss, damage, or inconvenience you suffer due to the actions of another user. Any claim should be directed against the responsible user. We also reserve the right to comply with any request or cooperate with law enforcement officials regarding identifying any user who assumes to use the website in violation of the law.
